Course overview
This seminar is meant to update practitioners on the law, taking into account recent case law, remedies and how to apply the Public Contracts Regulations 2015 to complex procedures, such as multi-party agreements, frameworks and dynamic purchasing systems.
Suitable audience:
Experienced lawyers and procurement professionals
Overview and topics to be covered include:
What can be learnt from current case law – including disclosure requirements, confidentiality issues and how to seek to limit potential liabilities. There will be practical assistance in drafting tender documentation, and advice based on real life scenarios.
Comments: Frequently, problems with procurement are caused by injurious behaviour by other departments of Authorities and we will seek to look to advise authorities on how to avoid getting into difficult situations.
Interactive elements
There will be a practical exercise requiring participants to show their knowledge of procurement law and its application.

Presenter profiles:
Nathan Holden is Head of Freeths Local Government Practice. He advised on a number of complex developments, including aspects related to State Aid, compulsory purchase, property issues and public procurement. He has recently been involved in a number of large-scale regeneration schemes for urban authorities in the South East.
Stephen is a Partner in Freeths Commercial / Public Sector Unit. He has recently been working on a number of complex outsourcings and the creation of joint venture entities utilised for development, including the Cambridge Investment Partnership and JV Companies across the North Midlands. He also advises on State Aid and governance issues.
Mark Gudgeon, Freeths is a professional litigator with particular interest in procurement litigation. Based in our Sheffield Office, has has recently acted for a number of Local Authorities defending against procurement actions and parties bringing challenges against national governance procured projects.
Bethan Lloyd is a partner at Geldards LLP in its Commercial Services Team. She specialises in State aid and public procurement law. She has provided State aid and procurement advice in relation to a wide range of projects including urban regeneration projects and major infrastructure projects.
Jonathan Griffiths is a partner in Geldards’ dispute resolution team and mainly acts on public sector disputes. He advises public authorities on procurement issues, particularly challenges and potential challenges to procurement decisions. He also speaks regularly on procurement related litigation.
Clare Hardy, Geldards provides advice on a wide range of local government law matters and also provides knowledge management on public law matters. She has advised local authorities and other public bodies on procurement and worked on a range of public sector projects.
