Seminar overview
The course is divided into two halves:

  1. Debt prevention, striking while the iron’s hot, knowing your debtor, sample letter of claim, county court action (including flow chart), interest and compensation costs, enforcement, common pitfalls.
  2. Statutory Demand (both in personal and corporate insolvency), bankruptcy, liquidation, the distinction between compulsory and voluntary liquidation, administration (including pre-packs), the aims and objectives of the insolvency practitioner
  3. Mediation – how the process works, how to prepare for it and practical hints and tips.

Topics to be covered include:

Speaker profiles:
Emma Birch at Weightmans has experience in all types of commercial dispute including breach of contract, breach of statutory duty, insolvency litigation, claims brought in tort such as negligence, defamation and restitution. Emma works for a wide variety of clients from the public, private and insurance sectors.
Andrea Clayton is a Fellow of the Chartered Institute of Legal Executives and has 18 years’ experience of contract disputes, debt recovery, bankruptcy, winding up proceedings, recovery of both residential and commercial rent arrears. Andrea joined Geldards in March 2012 and is an Associate within the commercial dispute resolution team based in the firm’s Derby office. Andrea acts for a wide range of PLCs, SMEs and individuals and supervises other more junior members of the team dealing with all manner of debt recovery and collections.
