Course overview

A practical session exploring the key employment and pensions law obligations for local authorities when dealing with TUPE transfers, whether the local authority is acting as transferor or transferee

Suitable audience:

In house legal, employment law and HR professionals

Overview and topics to be covered include:

• An overview of when TUPE applies and the obligations on both the transferor and transferee in a TUPE situation
• Managing the information and consultation process
• Identifying who and what transfers under TUPE
• Changing terms and conditions – when and how can this be achieved?
• Redundancy and reorganisations post transfer
• Public Sector Pension obligations including Fair Deal 2013 and Best Value Pension Direction 2007
• TUPE and Pensions and the procurement process

Presenter profiles:

Victoria Duddles, Weightmans, is an Associate in the Employment team and has over 20 years experience advising on all aspects of employment law including representing clients at Employment Tribunal. As well as being a qualified solicitor Victoria is a Fellow of the Chartered Institute of Personnel and Development (CIPD) and sits on the Birmingham CIPD branch as Policy Advisor. She is Staff Director at Birmingham Law Society and a member of their Employment Law Committee. Victoria has also had a period of secondment to the HR Department of Birmingham Children’s Hospital.

Paul Bownes, Weightmans has specialised in employment law since qualification as a solicitor. He deals with the full range of contentious and non-contentious matters from providing day to day advice and support through to helping to manage major projects and representing clients in the Employment Tribunal and Employment Appeal Tribunal.

Doug Mullen is a senior associate solicitor in the Employment and Pensions Department at Anthony Collins Solicitors LLP. He has substantial experience in advising on a wide range of areas but has particular expertise in advising on both the TUPE and Pensions aspects of TUPE transfers across the public sector. Clients say they appreciate the way that he brings clarity to complex areas of law. He is ranked as a next generation lawyer in the Legal 500.
