Seminar overview

In this seminar we will stage a mock mediation. We will look at all elements of mediation from choosing the most effective type of mediation to the appointment of the mediator and the mediation itself. In advance of the seminar we will circulate paperwork relating to the fictional mediation so that attendees can familiarise themselves with the facts.

The use of mediation is growing and with current proposals for reform is likely to grow even further. This seminar is primarily aimed at litigators but is suitable for anyone who has an interest in ADR, particularly mediation.

  • The different types of mediation
  • Appointing the mediator
  • How to prepare a position paper
  • Pre-mediation preparation
  • Opening the mediation
  • Mediation tactics and negotiation
  • Settling the claim

Duration: Half a day (3 CPD points) including lunch

Speaker profiles:

Nichola Evans, Browne Jacobson qualified as a Solicitor in 1993. She has extensive litigation experience and is known for her pro-active approach and for taking a robust view on cases at an early stage utilising ADR as an effective tool in the litigation process. Nichola sits on FOIL’s National Executive Committee. She also sits on the Law Society Council and the Law Society’s Civil Justice Committee. Nichola was also on the working party which dealt with the cost budgeting pilot in the Mercantile Court and the TCC. She is also a member of the Joint Tribunal.

Jonathan Butler at Geldards regularly acts for local authorities in judicial review and statutory appeals and is described by Legal 500 as one who “particularly impresses…”, one client remarking that he left “no stone unturned in protecting our position”.
