Course overview

Suitable audience:

Local authority contract / procurement lawyers; Commissioners from social services / public health teams

A session reviewing legal and practical issues for local authorities to consider when commissioning social care and health services. To include:

• The legal landscape eg
• Duties to act in partnership
• Sections 1 – 7 of the Care Act 2014
• public health duties
• Public Services (Social Value Act) 2012
• The bodies that make up the National Health Service in England, including their functions, legal status, and interrelationships Models of joint working
• Public Contracts Regulations 2015 – light touch regime
• NHS / Department of health standard contracts
• Data sharing

• Applicable Local Government law
• Procurement law
• General contract law
• Data law

Presenter profiles:

Deborah Down

Deborah is a Senior Associate at Sharpe Pritchard, joining it in 2014 after around 20 years working for a number of local authority legal departments.

Deborah advises on all aspects of public procurement law and projects with a particular interest in services contracts. She advises across many sectors of local government including health and social care, construction, education, facilities management, and leisure. She has an in-depth understanding of how local authorities work, advising on implementation of effective project management and governance across different specialisms in compliance with internal constitutional requirements.

Raj Shah joined Sharpe Pritchard as a Solicitor in 2014 after working at Lewis Silkin. He advises clients ranging from public sector bodies to private companies on contractual issues for a range of sectors, including health and social care, ICT, infrastructure, and other central and local government services.. Key specialisms include drafting commercial contracts and procurement tender documentation, as well as advising on intellectual property issues, especially relating to copyright and trade marks

Raj has delivered training on a number of topics, including the commissioning landscape in the procurement of health services, the implications of Brexit on public procurement and the use of pre-qualification questionnaires. He has also written articles that have appeared in Lawyer2B and ConsortEM magazines.
